MaxPreps Advantage Privacy Notice

Effective Date: July 1, 2025

This Privacy Notice is for the MaxPreps Advantage Platform (“MPA Platform”) provided by 2080 Media, Inc. d/b/a PlayOn! Sports (“PlayOn,” “we,” “us,” or “our”). This Privacy Notice (“Notice”) describes our information practices in connection with your use of our application (the “App”), or other online products and services that link to this Notice (together with the Apps, the “Services”) or when you otherwise interact with us or receive a communication from us related to the Services. Please read the following information carefully.

Some of the information received from our MPA Platform is collected or provided pursuant to an agreement with a school, including information that qualifies as “Student Data” under applicable state student privacy and data protection laws. PlayOn processes this information pursuant to its agreement with schools and not pursuant to this Notice.

1. Information Collected 

a. Information collected directly from you

We and our vendors may collect the following information:

  • Contact information, such as your name, billing and shipping address, e-mail address, and phone number;
  • Registration information, such as a username and password and other information you provide when you register for an account or sign up, including information related to your preferences;
    • Please note, if you have registered an account for VidSwap Services, information to enable you to use the MPA Platform may be provided to us by our partner Pixellot. To the extent that you still have a VidSwap Account, such Account shall be managed in accordance with both the VidSwap Master Services Agreement (which can be found at: Master Services Agreement - Pixellot Legal) and this Privacy Policy.
  • Information about you, such as your date of birth;
  • Professional or employment-related data, such as school name and position;
  • Transaction information, such as quantity and type of goods purchased, name of purchaser, and your payment information;
  • Correspondence and records of such correspondence, contents of communications and messages you send us, recordings of phone calls to customer support, or support inquiries;
  • Contact information about others, such as name and email address you disclose to the Services;
  • Information about how you use the Services;
  • Feedback, testimonials, or other information you choose to provide to us about your use of the services; and
  • Your general location (i.e., city/state derived from your IP address).

Your information may be collected at different times, including when you create an account, request information, or use the Services.

b. Cookies and Other Information Collection Technology

We and third parties may collect information from your computer or other device by automated means such as cookies, web beacons, local storage, JavaScript, mobile-device functionality, software development kits (SDKs), and other computer code. This information may include unique browser identifiers, IP address, browser and operating system information, device identifiers (such as advertising identifiers), other device information, Internet connection information, as well as details about your interactions with the relevant website, app, email or other online property (for example, the URL of the third-party website from which you came, the pages on our website that you visit, and the links you click on in a website). In some cases (such as cookies), the tools described here involve storing unique identifiers or other information on your device for later use.

c. Information from Third Parties

We may collect certain information about you from third parties, including:

  • When you interact with our social media pages, such as by “liking” or “following” our page or posting comments or replies to our content, consistent with your privacy settings on that platform.
  • Our service providers, affiliates, and partners, such as organizations with whom we partner on events and contests.

For a description of how these third parties handle and disclose your information, please refer to their privacy policies, which may permit you to modify your privacy settings. We may combine information that we collect from or about you with information about you that we obtain from third parties, including social media and other content platforms.

2. Use of Information

We and our service providers use the information described above for the following purposes:

  • To provide, manage, and improve our services;
  • To conduct business operations in support of the services we provide, such as auditing, security, fraud prevention, invoicing and accounting, sales and marketing, analytics, and research and development;
  • To contact you regarding our services and surveys, research studies, promotions, special events, and other subjects that we think may be of interest to you;
  • To customize content and preferences on our Services;
  • To create aggregated or de-identified information;
  • To address laws, regulations, and other legal process and procedures; and
  • To establish, exercise, or defend our legal rights.
  • In any other way we may describe when you provide the information and for any other purpose for which you provide it or with your consent.

We may also draw inferences from this information, aggregate this information, and use this inferred and/or aggregate information to inform the operation of the Services, enhance your experience, or for any other lawful purpose.

3. Disclosure of Information

We may disclose your information as follows:

  • To Service Providers: We may disclose your information to companies that provide services to us, such as providers of data storage, web hosting, security, analytics, marketing, and fraud prevention. We may engage a service provider to host or operate any aspect of our business, potentially including any mechanism through which we send or receive communications, such as our email systems and Apps. Service providers engaged in this manner may collect information from you directly when you interact with us.
  • To Affiliates: We may disclose information to other members of our corporate family for the purposes described in this Notice.
  • To Business Partners: We may disclose information to business partners, such as resellers and distributors.
  • For Legal Reasons: We may disclose information when we believe disclosure is appropriate due to a subpoena or similar investigative demand, a court order, or other request from a law enforcement or government agency; or as otherwise required by law.
  • For the Protection of MaxPreps Advantage and Others: We may disclose information when we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding suspected fraud or other illegal activity or wrongdoing; to protect and defend the rights, property or safety of our company, our employees, our customers, or others; and to enforce our contracts.
  • Corporate Transactions: We may disclose your information as part of, or to take steps in anticipation of, a sale of all or a portion of our business, a divestiture, merger, consolidation, asset sale, bankruptcy, or other significant corporate event.
  • Your Consent: If you have consented to or directed us to engage in additional disclosure of your information, we may do so.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

4. International Data Transfers

We are headquartered in the United States, and recipients of the data disclosures described in this Privacy Notice are in the United States and elsewhere in the world, including where privacy laws may not provide as much protection as the laws of the country where you live.

5. Links to Third Parties

The Services may contain hyperlinks to websites owned and operated by third parties. Where this is the case, we urge you to review the equivalent data protection, privacy and cookie policies available on such websites. This Notice does not apply to such third-party websites. We do not accept any responsibility or liability for the data protection of privacy practices of third parties in relation to such websites and your use of third-party websites is entirely at your own risk.

6. Your Rights and Choices

You can unsubscribe from our marketing emails by clicking the unsubscribe link in a marketing email or contacting us as described below.

If you are a California, Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia resident, you may request:

  • Access to and/or a copy of certain personal information we hold about you or to have certain information you gave us transferred to another entity.
  • Correction of inaccurate personal information we hold about you.
  • Deletion of certain personal information we have about you.
  • Information about the financial incentives that we offer to you, if any.
  • Restriction of or objection to certain processing of your information, if applicable.
  • To opt out of the processing of your personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects, if applicable.
  • Oregon and Minnesota residents can request a list of the specific third parties, other than natural persons, to which personal information has been disclosed, if applicable.

If you are a California resident, please see Section 11 below (“Additional Information for California Residents”) for additional information about our data processing and your rights under applicable law.

Residents of the states listed above also have the right to opt out of the “sale” of their personal information, “sharing” of personal information for cross-context behavioral advertising, or processing of personal information for targeted advertising. However, we do not engage in such sales, sharing, or processing with respect to information collected through the Services.

Many of the rights described above are subject to limitations or exceptions under applicable law. You have a right not to face retaliation or receive other discriminatory treatment, as such terms are used in applicable law, for the exercise of the privacy rights conferred by those laws.

We will take reasonable steps to verify your identity before responding to a request, which may include, depending on your request and relationship with you verifying your name, email address, address, and/or having you respond to an email from us. Please note that if you are a student user of the Services and would like to make a request regarding your Student Data that we process on behalf of the school, you will need to contact your school regarding your rights with respect to that data.

Residents of certain states are also permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, we may require proof of your written authorization before processing the request. We may also follow up with you to verify your identity before processing the authorized agent’s request.

If you wish to exercise any of these rights, or raise a complaint about our handling of your personal information, please contact us as described at the end of this Notice. You also have a right to file a complaint about our privacy practices with the relevant supervisory authority, but we respectfully invite you to contact us first, as we would like to do our best to resolve any concern you may have.

7. Protection of Information

We have implemented administrative, technical, and physical security measures to protect against the loss, misuse and/or alteration of your information. These safeguards vary based on the sensitivity of the information that we collect and store. However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect information, we cannot ensure or warrant the security of any information you transmit to us or through the use of the Services and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk.

8. Retention of Information

We will retain personal information until after we determine that we no longer need it to fulfill the purposes outlined in this Notice, unless the law requires us to keep it for a longer period of time. To provide security and business continuity for the activities described in this Notice, we make backups of certain data, which we may retain for longer than the original data.

9. Updates and Changes to this Policy

We may update this Notice from time to time, such as to reflect changes in our practices or for legal reasons. We will post those changes here or on a similarly accessible page.

11. Additional Details for California Residents

This Section 11 applies only to “personal information” about California residents, as that term is defined in the California Consumer Privacy Act (“CCPA”), and it supplements (and, in some cases, repeats) the information in the rest of our Notice above. Data about individuals who are not residents of California is handled differently and is not subject to the same rights described in this Section. This Section does not apply to data that we process in our capacity as a processor for its schools, even when such data is about a resident of California, or to other data or activities that are not subject to the relevant provisions of the CCPA.

Categories of Personal Information Collected

We and our service providers collect the following categories of personal information:

  • Identifiers, such as name, address, phone number, email address, online identifiers and date of birth.
  • Login information, such as username and password.
  • Device identifiers, such as IP address.
  • Internet or network activity information, such as browsing history and interactions with our Services and applications.
  • General geolocation data, such as city, state, and zip code.
  • Communication or feedback that you provide.
  • General location information.
  • Inferences drawn from any of the personal information listed above to create a profile or summary about, for example, an individual’s preferences and characteristics.

As described above, this information is collected directly from California residents themselves, through automatic data collection technologies, and from third parties.

Use and Disclosure of Personal Information

We may use this information to operate, manage, and maintain our business, to provide our Services, and to otherwise accomplish our business purposes and objectives. Our business purposes and objectives include,

  • To provide, manage, and improve the Services;
  • To conduct business operations in support of the Services, such as auditing, security, fraud prevention, invoicing and accounting, sales and marketing, analytics, and research and development;
  • To contact you regarding our Services and third-party products, services, surveys, research studies, promotions, special events, and other subjects that we think may be of interest to you;
  • To customize content and preferences on our Services, across the Internet and elsewhere;
  • To create aggregated or de-identified information;
  • To address laws, regulations, and other legal process and procedures; and
  • To establish, exercise, or defend our legal rights.

We also may disclose these categories of personal information to third parties, including our affiliates and service providers, for our operational business purposes.

Sale/Sharing of Personal Information

We do not engage in “sales” or “sharing/processing for purposes of targeted advertising,” as such terms are used in the CCPA.

Additional Privacy Rights.

If you are a California consumer, you may have the rights in the “Your Rights and Choices” section above.

The CCPA also allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes. Please note, in the limited circumstances that we process sensitive personal information (such as usernames in combination with passwords) as defined in the CCPA, we do not use or disclose it other than for disclosed and permitted business purposes for which there is not a right to limit under the CCPA.

Retention.

We will retain personal information until after we determine that we no longer need it to fulfill the purposes outlined in this Notice, unless the law requires us to keep it for a longer period of time. To provide security and business continuity for the activities described in this Notice, we make backups of certain data, which we may retain for longer than the original data.

If you opt out of email marketing, we maintain your email on our suppression list for an extended time to comply with your request.

To dispose of your information, we may anonymize it, delete it or take other appropriate steps. Data may persist in copies made for backup and business continuity purposes for additional time.

California Shine the Light.

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Services that are California residents to request certain information regarding our disclosure of “personal information” (as defined by that law) to third parties for their own direct marketing purposes. We do not provide such information to third parties for their own direct marketing purposes.
